The President of Fair Work Australia on 27 August 2010 issued a statement in relation to the termination of modernisable instruments and the process to be undertaken regarding submissions that a particular modernisable instrument not be terminated.

Filing fee—Dismissals & general protections applications

The filing fee for dismissals and general protections applications made under ss.365, 372, 394 and 773 of the Fair Work Act 2009 will increase to $60.60 from today.

In other changes commencing today, the high income threshold in unfair dismissal cases will increase to $113,800 and the compensation limit will be $56,900.

Determinations varying modern awards in relation to the Annual Wage Review 2009–10 and expense-related allowances are being published progressively as they are finalised.

Division 2B State awards—30 June 2010 deadline

From 31 December 2010, a group of State awards known as the 'Division 2B State awards' will cease to have effect. From that date, employers and employees previously covered by a Division 2B State award will be covered by a modern award.

Fair Work Australia is currently accepting applications from interested parties who want the tribunal to:

  • vary a modern award to continue the effect of the terms of a Division 2B State award beyond its termination date
  • make an order continuing the effect of a Division 2B State award beyond its termination date in relation to long service leave.

Such applications need to be lodged by 30 June 2010.

The Minimum Wage Panel today issued the decision in the Annual Wage Review 2009–10.

Fair Work Australia Rules 2009—Amended

The President of Fair Work Australia today signed an amendment to the interim Fair Work Australia Rules 2009.

The change includes modifications to the following forms:

  • F47A—Application for a take-home pay order (individual employee/outworker)
  • F47B—Response to an application for a take-home pay order (individual employee/outworker)
  • F47C—Application for a take-home pay order (multiple employees/outworkers), and
  • F47D—Response to an application for a take-home pay order (multiple employees/outworkers).

The Minimum Wage Panel today issued a statement in relation to additional material for the Annual Wage Review 2009–10.

Fair Work Australia Rules 2009

The President of Fair Work Australia on 13 April 2010 signed an amendment to the interim Fair Work Australia Rules 2009.

The changes include new rules in relation to employer responses to applications for unfair dismissal remedy (rule 14A), general protections (rule 16A) and take-home pay orders (rule 16B), and the publication of new forms:

  • F8A—Employer response to application for FWA to deal with a general protections dispute
  • F47A—Application for a take-home pay order (individual employee/outworker)
  • F47B—Response to an application for a take-home pay order (individual employee/outworker)
  • F47C—Application for a take-home pay order (multiple employees/outworkers), and
  • F47D—Response to an application for a take-home pay order (multiple employees/outworkers).

Changes have also been made to forms F3, F8, F9–10, F16–17, F20, F24, F28 and F37.

Fair Work Australia Rules 2009

The President of Fair Work Australia yesterday issued an amendment to the Fair Work Australia Rules 2009. The amendments include a new rule in relation to reviews of decisions (rule 13A), and changes to forms F2–3, F6, F8, F10, F16–17, F19–20 and F23. Forms F15, F26 and F27 no longer apply.
