13. DISPUTE SETTLEMENT PROCEDURE

13.1 In the event of a dispute arising in the workplace, the procedure to be followed to resolve the matter will be as follows:

13.1.1 The Flight Attendant(s) concerned will first meet and confer with the appropriate Employer representative. The Flight Attendant(s) may be represented by another Flight Attendant from the same Employer or a representative of the Association.

13.1.2 If the matter is not resolved at the first meeting, the parties will arrange further discussions involving more senior management The Flight Attendant(s) may be represented by another Flight Attendant from the same Employer or representatives of the Association. If the matter is still not settled either party may notify the existence of an industrial dispute to the Commission.

13.2 In order to facilitate the procedure:

13.2.1 The party with the grievance must notify the other party at the earliest opportunity of the problem.

13.2.2 Throughout all stages of the procedure all relevant facts must be clearly identified and recorded.

13.2.3 The Employer will provide, to the Flight Attendant concerned, copies of all relevant correspondence/statements relating to them that the Employer seeks to rely on at the time of receipt of such correspondence/statements. The Flight Attendant will be provided an opportunity to respond in writing to the correspondence/statements.

13.2.4 Sensible time limits must be allowed for completion of the various stages of discussion. However, the parties must co-operate to ensure that the disputes resolution procedures are carried out as quickly as possible.

13.3 If the Employer (or another body) is investigating an accident or incident in which the Flight Attendant(s) may be involved, and where the investigation involves a member of the Association, the Association has the right to nominate a representative who may act as an observer and be present at all stages of the Employer’s investigation.

13.4 While the parties attempt to resolve the matter work will continue as normal (as directed by the Employer) unless a Flight Attendant has a reasonable concern about an imminent risk to their health and safety.
