10. INDEX OF FACILITATIVE PROVISIONS

10.1 A facilitative provision is one which provides that the standard approach in an award provision may be departed from by agreement between the Employer and the Association and/or a Flight Attendant, or the majority of Flight Attendants, in the enterprise or workplace concerned.

10.3 Agreements made pursuant to this clause will be recorded in writing and be provided to every affected Flight Attendant on request.

10.4 For the purposes of these facilitative provisions an employee may nominate the Association or another employee representative to represent them.

10.5 Facilitative provisions are not to be used as a device to avoid award obligations nor should they result in unfairness to an employee or employees covered by this award.

10.6 Any dispute arising from the implementation, or continuing operation, of a facilitative provision will be handled in accordance with clausel3 — Dispute settlement procedure.
