9. ENTERPRISE FLEXIBILITY

9.1 A consultative mechanism (comprising representatives of the company and the Association or other employee representative) and procedures appropriate to the size, structure and needs of the enterprise or workplace will be established.

9.2 The purpose of this consultative mechanism and procedures is to establish, in accordance with s.113A of the Act, a process for agreements to be negotiated at the enterprise about how this award could be varied so as to make the enterprise operate more efficiently according to its particular needs.

9.3 Where agreement is reached an application to vary this award must be made to the Commission.
